This Privacy Policy and its Addendums (“Privacy Notice”) describe how Baik Super Corp, its respective subsidiaries, affiliates, associated companies, and jointly controlled entities (collectively referred to as “Baik,” “we,” “us,” or “our”) collect, use, process, and disclose your Personal Data through the use of Baik’s mobile applications and websites (collectively, “Applications” and “Websites”), as well as products, features, and other services globally operated by Baik (collectively, “Services”).

This Notice applies to our consumers, agents, vendors, suppliers, partners (such as vehicle owners, vehicle rental suppliers, business partners), contractors, and service providers (collectively referred to as “You,” “Your,” “Yours”). We use your personal data to provide and improve the Services. By using the Services, you consent to the collection and use of information per this Privacy Policy.

Definitions

For the purposes of this Privacy Policy, the following terms have the meanings ascribed to them below:

• Account: A unique account created for you to access our Service or parts of our Service.
• Affiliate: An entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
• Application: Refers to Baik and Baik Partner, software provided by the Company.
• Company: (referred to as “the Company,” “we,” “us,” or “our”) means Baik Super Corp., JALAN TUKAD BALIAN NO.161B RT.00 RW.000, Kota Denpasar, Bali 80227.
• Country: Refers to Indonesia.
• Device: Any device that can access the Service, such as a computer, a cellphone, or a digital tablet.
• Personal Data: Any information that relates to an identified or identifiable individual.
• Service: Refers to connecting Consumers with Partners or other Consumers via the Application, Platform, and/or Software.
• Service Provider: Any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, provide the Service on behalf of the Company, perform services related to the Service, or assist the Company in analyzing how the Service is used.
• Third-Party Social Media Service: Any website or any social network website through which a User can log in or create an account to use the Service.
• Usage Data: Data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
• Client/Consumer/User: Any end-user who accesses or uses the Platform to search for and receive Solutions.
• Contractor/Partner/Supplier/Vendor: Independent third parties (not Baik) that provide relevant Solutions to Consumers via the Service.

Collection and Use of Your Personal Data

“Personal Data” means any information that can be used to identify you or from which you can be identified. During your use of our Service, we may ask you to provide certain Personal Data that can be used to contact or identify you.

“Consumer Personal Data” in the application includes, but is not limited to:

• Phone number,
• Your name,
• Nationality,
• Email address,
• Bank and credit card details,
• Financial information,
• Personal interests,
• Usage data,
• Biometric data,
• Your image,
• Gender,
• Date of birth,
• Marital status,
• Religion,
• Health information.

“Partner/Supplier/Service Provider Personal Data” in the application includes, but is not limited to:

• Nationality,
• Phone number,
• Email address,
• Your image,
• Government-issued identification numbers,
• Biometric data,
• Gender,
• Date of birth,
• Marital status,
• Religion,
• Health information,
• Vehicle and insurance details,
• Bank and credit card details,
• Employment information and financial information,
• Personal interests.

We typically collect, use, disclose, or otherwise process your Personal Data in accordance with this Privacy Policy, with your consent or as required by applicable laws, such as when:

• It is required to fulfill legal obligations;
• It is necessary to enter into or perform a contract with you; and/or
• For our legitimate interests or legitimate interests of any other persons, including but not limited to the purposes set out in this Privacy Notice.

I. COLLECTION OF PERSONAL DATA

We collect your Personal Data in the ways described below. We may also combine Personal Data collected through these various channels:

You provide us with your Personal Data

• We collect your Personal Data when you provide it to us. For example, when you:
  • Complete user profiles or registration forms (such as name, contact details, and other identification data if necessary);
  • Provide information for assessing eligibility to provide services as a Baik partner or supplier (such as ID proof, vehicle information, and background check results, transportation insurance information);
  • Interact with our social media pages (e.g., social media account ID, profile photo, and any other publicly available data);
  • Participate in contests or events organized by us (such as photos, audio recordings, or videos you submit which may contain your image);
  • Verify your identity in various ways (such as logging in via social media, uploading selfie photos, or independently verified card details);
  • Complete surveys with demographic data (such as age, gender, and other information you may voluntarily provide or may appear on your identification documents, such as marital status, occupation, and income information).

When you use our services

• Personal Data may be collected during the normal course of your use of our applications, websites, and services. Examples include:
  • Information about your location;
  • Feedback, ratings, and compliments;
  • Transaction information (such as payment method);
  • Information on how you interact with our applications, website, or services (e.g., features used and content viewed);
  • Device information (such as hardware model and serial number, IP addresses), file and application names and versions, GPS location, IMEI number, and advertising identifiers or any information that may indicate device or application modification;
  • Personal Data you enter in messages when using our in-app communication features;
  • Personal Data that may be captured during your interaction with us, our agents, audio and/or video recordings (such as your image or voice or both, and related metadata).

From other sources

• We may collect Personal Data, including but not limited to your name, contact details, and other identification data, if necessary, from other sources. Such sources include but are not limited to:
  • Referral programs;
  • Our business partners, e.g., transportation providers, payment service providers;
  • Insurance and financial services providers;
  • Publicly available or government sources;
  • When our users add you as an emergency contact;
  • When our users add you as a recipient or beneficiary of our Services;
  • When you use our in-app chat service; and
  • Marketing service providers or partners.
• The Company allows you to create an account and log in to use the Service via the following third-party social media services:
  • Facebook
  • Google
  • LinkedIn
  • Apple
• If you choose to register through a third-party social media service or otherwise grant us access to a third-party social media service, we may collect Personal Data that is already associated with your third-party social media account, such as your name, email address, activities, or your contact list associated with that account.
• You may also have the option of sharing additional information with the Company through your third-party social media account. If you choose to provide such information and Personal Data during registration or otherwise, you give the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

Sensitive Personal Data

• Some of the Personal Data we collect may be sensitive. This may include Personal Data about your race, ID-related information, religious beliefs, background information (including financial data and criminal record if legally permissible), health data, disabilities, marital status, and biometric data, as applicable. We collect sensitive Personal Data only with your consent and/or in strict compliance with applicable laws. If it is necessary to provide us with any documentation or information for any Purpose that may contain such sensitive Personal Data (which is not required for that Purpose), you agree to redact such sensitive Personal Data before providing us with such documentation or information.

When you provide us with personal data of other individuals

• In some situations, you may provide us with the Personal Data of other individuals (such as a spouse, family members, or friends). For example, you may add them as emergency contacts, use the in-app chat to add them, or add them as recipients or beneficiaries of our Services. If you provide us with Personal Data, you represent and warrant that you have obtained that person’s consent for the collection, use, and disclosure of their Personal Data per this Privacy Policy.

Personal Data of minors

• As a parent or legal guardian, please do not allow minors under your care to submit Personal Data to Baik. In the event that such Personal Data of a minor is disclosed to Baik, you hereby consent to the processing of the minor’s Personal Data and accept and agree to be bound by this Privacy Notice and take responsibility for their actions.

II. USE OF PERSONAL DATA

Baik may use your Personal Data for the following purposes (“Purposes”). Additionally, if you use Baik for different purposes (e.g., if you are both a partner and a consumer), we may combine your Personal Data collected in different capacities to facilitate your use of our Services and for the purposes described below:

Providing services and features

• Your Personal Data will be used to deliver, personalize, maintain, and improve our applications, websites, and services. This includes using your Personal Data to:
  • Engage you in providing Services in various areas of our business;
  • Create, administer, and update your account;
  • Process, manage, or verify your eligibility for products, Services, promotions, rewards, and subscriptions via Baik;
  • Conduct due diligence checks and risk assessments/analyses;
  • Verify your identity and age (if necessary);
  • Approve your rental and process payments;
  • Enable you to participate in loyalty programs or marketing activities organized by our business partners and/or in conjunction with Baik;
  • Personalize your use of the Applications (e.g., recommending relevant products and services, identifying your preferences, or otherwise personalizing your experience with Baik);
  • Make your service experience more seamless, such as by pre-filling registration information (such as your name or phone number) from one Service to another or when you participate in our surveys;
  • Perform internal operations necessary to provide our Services, including troubleshooting software bugs and operational issues, conducting data analysis, testing, and research, and monitoring and analyzing usage and activity trends;
  • Protect the safety or integrity of the Services and any facilities and equipment used to make the Services available;
  • Facilitate communication between our users;
  • Invite you to participate in our surveys and research;
  • Enable our partners to manage and allocate fleet resources; and
  • Perform services for you as a data processor if you have consented to the data controller (i.e., the organization from which you purchased goods or services and for which Baik provides services) to provide such services.

Security and protection

• We use your data to ensure the safety of our Services and all users. This includes:
  • Conducting background checks on suppliers before allowing them to use our Services;
  • Identifying dangerous information shared through Baik’s communicators;
  • Verifying your identity when logging into Baik;
  • Using device, location, profile, usage, and other Personal Data to prevent, detect, and combat fraud or unsafe activities;
  • Monitoring compliance with our terms and policies.

User support

• We use Personal Data to resolve user support issues. For example, we may:
  • Investigate and address concerns;
  • Monitor and improve our responses to user support issues;
  • Respond to questions, comments, and feedback; and
  • Inform you of steps taken to resolve user support issues.

Research and development and security

• We may use the Personal Data we collect for testing, research, analysis, and product development. This allows us to understand and analyze your needs and preferences, protect your Personal Data, improve and enhance the safety of our Services, develop new features, products, and services, and facilitate the development of financial solutions.

Legal purposes

• We may use the Personal Data we collect for legal purposes, such as investigating and resolving claims or disputes, detecting, preventing, and prosecuting crimes, or as permitted or required by applicable law.
• We may also use your Personal Data when it is required, advised, recommended, expected, or requested by our legal advisors or any local or foreign legal, regulatory, governmental, or other authorities.
• For example, we may use your Personal Data to:
  • Comply with court orders or other legal, governmental, or regulatory requirements;
  • Enforce our Terms of Service or other agreements; and
  • Protect our rights or property in case of claims or disputes.

Marketing and promotions

• We may use your Personal Data to send you marketing communications about customized products or services (that may be of interest or relevant to you based on your profile) or products, services, events, or promotions of Baik’s partners, sponsors, and advertisers. For example, we may:
  • Send you special offers that may interest or be relevant to you across all Baik service offerings;
  • Send you notifications, newsletters, updates, mailers, promotional materials, special privileges, holiday greetings; and
  • Notify, invite, and manage your participation in our events or activities.
• Where applicable, we may communicate such marketing information to you through various means (including SMS, chat applications (e.g., WhatsApp, Telegram, LINE, Viber, WeChat, Zalo), push notifications, phone calls, and email).
• If you wish to unsubscribe from receiving such marketing communications, click the unsubscribe link in the relevant email or message. Alternatively, you can update your preferences in the settings of our application. Please note that while you may opt-out of marketing or promotional communications, Baik may still send you messages related to your account and/or services (such as two-factor authentication, information about your transactions, rewards, etc.).

User-published content

• If you post content (such as a review or comment) on the Baik platform, it will be made public along with your personal information (such as profile name, submitted photos) and any other information you decide to include in your content.

III. DISCLOSURE OF PERSONAL DATA

We need to share Personal Data with various parties for the Purposes. These parties include:

Other users

• For example:
  • If you are a customer of our partner, we may share your username, delivery, and pickup locations with our partner to fulfill your service order;
  • If you are a partner, we may share your customers’ personal information, including your name and photo; brand, model, registration number, location, and average rating of your vehicle;
  • If you participate in loyalty programs or marketing activities organized by our business partners, we may share your Personal Data with them, including your name and contact details;
  • If you are a supplier, we may share your personal information with the selected customer partner and user, including your name and photo; brand, model, location, and average rating of your vehicle;
  • If you use our in-app chat service, we may share your registered phone number and name in Baik with other parties in your chat.

Third parties in connection with your use of Baik Services

• For example:
  • If you are a customer, we may share the vehicle data you use and your name with third parties;
  • If you use our payment services, we may share your personal data with another person if you allow and enable their payment method in the third-party service to be linked to our payment service to facilitate payment in Baik.

Account administrators of Baik accounts you may use

• For example:
  • The administrator of any social group you connect your Baik account with may receive transaction data during transactions.

Subsidiaries and affiliates

• We may share Personal Data with our subsidiaries, affiliates, jointly controlled entities, and associated companies. Baik group companies share resources, such as infrastructure and technology, to provide a consistent, relevant, and secure user experience when using our products or Services and for the purposes outlined in this Privacy Policy.
• For example, we may do this to provide you with a smoother experience, such as by automatically filling out registration data for using one Baik Product or Service when registering for a new Baik Product or Service.

Baik’s service providers and business partners

• We may provide Personal Data to our service providers, consultants, marketing partners, research firms, and other service providers or business partners. This includes:
  • Payment processors and facilitators;
  • Debt collectors;
  • Background check and anti-money laundering service providers;
  • Cloud storage providers;
  • Document storage and management providers;
  • Advertising and marketing partners and platform providers;
  • Data analytics providers;
  • Research partners, including those conducting surveys or research projects in partnership with Baik or on Baik’s behalf;
  • Educational and training institutions and partners;
  • Fleet and trading partners;
  • Service providers providing identity verification services; and
  • Automotive solution partners or external vehicle providers.
• For example:
  • If you requested a service through a Baik partner or used a promotion offered by a Baik partner, Baik may share your personal data with that Baik partner.

Our legal advisors and government authorities

• We may share your personal data with our legal advisors, law enforcement officers, government authorities, and other third parties. This may occur for legal purposes (listed above) or in any of the following circumstances:
  • When necessary to respond to an emergency that threatens the life, health, or safety of a person; or
  • When necessary in the public interest (e.g., during a public health crisis to establish contact tracing and protect our community).

Business transfers

• We may share your personal data with other parties in connection with any acquisitions, sales, mergers, joint ventures, consolidations, restructurings, financings, or any other type of business transactions. However, your personal data will continue to be subject to our obligations as outlined in any pre-existing Privacy Notices to which you have consented.

IV. RETENTION OF PERSONAL DATA

We retain your personal data for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When your personal data is no longer necessary for providing Services or Purposes, or we no longer have a legal or business purpose to retain your personal data, we take steps to delete, destroy, anonymize, or prevent access to or use of such personal data for any purpose other than compliance with this Notice or for security, protection, fraud prevention, and detection, as required by applicable law.

V. COOKIES, RELATED TECHNOLOGIES, AND ADVERTISING ON THIRD-PARTY PLATFORMS

Cookies

• Baik and third parties we work with may use cookies, web beacons, tags, scripts, local shared objects such as HTML5, advertising identifiers, and similar technologies (such as software development kits (SDKs) that have cookie-like functions and may be installed in the Baik Application to enable partners to collect certain information about your interaction with the Baik Application) (collectively, “cookies”) in connection with your use of the Websites and Applications, which may be persistent or stored only during an individual session on your browsers or devices.
• Cookies may have unique identifiers and reside, among other places, on your computer or mobile device, in emails we send to you, and on our websites. Cookies may be used for various purposes, such as:
  • Providing essential, basic functions of using our Websites, Services, or Applications;
  • Authenticating you or remembering your user preferences and settings;
  • Delivering and measuring the effectiveness of advertising campaigns, e.g., by counting the number of views or clicks;
  • Analyzing site traffic and trends;
  • Showing you relevant advertisements in other applications and websites owned by other companies (ours or other advertisers);
  • Improving the user interface and experience by gaining a general understanding of users’ online behavior and interests interacting with our Website, Services, or Applications.
• Baik may allow third parties to use cookies on the Websites and Applications to collect the same types of personal data for the same purposes Baik does for itself. Third parties may have the ability to associate the personal data they collect with other personal data they have about you from other sources. We may not necessarily have access to or control over the cookies these third parties use.

Disabling cookies collection on our websites

• You have the right to choose to disable, block, or deactivate cookies. However, please note that refusing or removing some cookies may affect the availability, functionality, or use of our Website, Services, or Applications.
• You can adjust your web browser settings to disable, block, or deactivate cookies, delete your browsing history, or clear your web browser cache. Settings may be included in the “History,” “Preferences,” “Settings,” or “Privacy” section of your web browser. Alternatively, you can refer to your web browser’s help section for more information.

Disabling targeted advertising on other platforms

• We may facilitate the display of targeted advertising on other platforms, such as other web platforms that you may be a user of.
• You may have the option to limit our use of your personal data for displaying targeted advertising on behalf of our advertisers by adjusting your preferences through our Baik application. Depending on the type of phone and operating software you use, you may have the option to disable our use of mobile identifiers (such as Apple IDFA or Google GAID) and the ability to track you in apps and websites owned by other companies by adjusting the settings available on mobile devices. By adjusting the settings on your device, you can typically reset, delete, restrict, and/or otherwise limit the use of such mobile identifiers.
• Although we will not use your personal data to display such targeted advertising on other platforms, you may still see general advertisements that appear relevant to you. This may be because we have engaged third-party advertisers/platforms to display advertisements to users with certain characteristics or demographic structure, which may find them relevant. You can limit the display of these advertisements by managing your preferences on those platforms.

VII. PROTECTION OF PERSONAL DATA

We will take reasonable legal, organizational, and technical measures to ensure the protection of your personal data. This includes measures to prevent the loss of Personal Data, its misuse, or unauthorized access. We limit access to your personal data to our employees on a need-to-know basis. Those processing your Personal Data will do so only in an authorized manner and are obligated to treat your personal data confidentially. However, please understand that transmitting information over the Internet is not completely secure. While we will strive to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted online, and any transmission is at your own risk.

VIII. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

According to applicable laws and regulations, as a user of our application, you have several rights related to your personal data. Your rights include:

• Right to data portability: You have the right to request receiving or transferring your personal data to another organization in a machine-readable format. To exercise this right, contact us at support@baik.asia.
• Right to lodge complaints: If you believe your privacy rights have been violated or you have suffered damage due to unlawful processing of your personal data, you have the right to lodge a complaint with the appropriate data protection authority.

If you have the option to provide us with your personal data, you may always choose not to. If we requested your consent for processing and you later decide to withdraw it, we will respect that decision in line with our legal obligations. However, if you choose not to provide us with your Personal Data, withdraw consent for its use, or consent to our Privacy Policy, this may mean we are unable to carry out actions necessary to achieve the processing purposes described in Part II (Use of Personal Data) or that you may not use the Application or Services. After withdrawing consent, we may continue to process your personal data to the extent required or otherwise permitted by applicable statutory and executive regulations. We will review and verify all requests beforehand. To verify your eligibility to make a request, we may require you to provide additional information or documents supporting the request. Once verified, we will fulfill your request within the timeframes provided by applicable law.

IX. AMENDMENTS AND UPDATES

Baik may modify, update, or change the terms of this Privacy Policy at any time. You will be notified of such changes via the Application and/or in another appropriate manner at least five (5) business days before the effective date. The updated version will be posted on the website: https://baik.asia/privacy-policy/. It is your responsibility to review the Privacy Policy regularly. Your continued use of the Application, Websites, or Services, or continued communication or cooperation with Baik after modifications, updates, or amendments to this Notice, whether you have reviewed them or not, will constitute your consent to be bound by such amendments.
